Terms of use for Markedsradar

1. Who the agreement applies to

The service is provided by FullPeiling AS, organisation number 938 341 508, Kokstadvegen 41, 5257 Kokstad, Norway. In these terms, that is “we”.

The customer is the business that creates an organisation in Markedsradar. That is “you”. The person who creates the organisation confirms that they have the right to enter into the agreement on behalf of the business. Users are the people you give access.

Markedsradar is made for businesses with an organisation number, not for consumers. The agreement is made between businesses, and the Norwegian Cancellation Act (angrerettloven) does not apply.

When you create the organisation and start the trial, you accept these terms and the data processing agreement, and confirm that you have read the privacy notice. When you order, you accept the terms and the data processing agreement again, and we store which version you accepted.

The terms are available in Norwegian and English. The Norwegian text is binding. If the two say different things, the Norwegian text applies.

2. What the service is

Markedsradar is your business's own newspaper about its market. You enter the name or organisation number of your business. We fetch information from the Central Coordinating Register for Legal Entities (Enhetsregisteret) and from the business's public website, and use it to suggest a watchlist: competitors, customers, suppliers and your industry. You remove those that do not fit, and add those that are missing.

We then collect news about these companies and gather it in your newspaper. The sources include Enhetsregisteret, the companies' own websites and web searches. When several customers follow the same company, we collect the stories once and show them to everyone who follows it.

Without an account, you can make a draft of the watchlist. The draft is kept for 30 days.

3. Suggestions, summaries and signals are not advice

The suggested companies are made automatically, and so is what the newspaper writes about each story: the headline, the summary, the Opportunity and Risk signals, “Why you're seeing this” and “Suggested next step”. They are made partly with language models, and can be wrong, incomplete or out of date. A story can be about another business with the same name, and a summary can leave out something the story says.

The newspaper gives you an overview. A signal or a suggested next step is a suggestion for what you may want to look into, not advice. The newspaper does not replace your own research or advice from a lawyer, an auditor or other advisers. Read the story at the publisher before you act on it. If you find a mistake, we would like to hear about it.

4. The news and the publishers' rights

For each story we show a headline and a short summary we write ourselves, the original headline, the name of the publisher and a link to the story at the publisher. The main image is shown directly from the publisher's website, with credit. We do not store the images. If a story has no image we can show, we show the company's logo or no image.

The stories, the original headlines and the images belong to the publishers and photographers. The headlines and summaries we write are ours. The newspaper is for use within your business. If you want to use content from a story outside Markedsradar, you must follow the publisher's terms.

We follow the publishers' signals about what may be shown in previews, as they stand when we collect the story, and we never get around paywalls or other barriers. If the publisher says no to snippets, or we cannot read the page, we show the story without a summary, with the headline, the original headline and the link. If the publisher says no to images in previews, we do not show the image.

If a publisher, a photographer or a person mentioned in a story believes we show something we should not, they can write to hei@fullpeiling.no. We look at the request quickly, and remove the story, the image or the summary when there is reason to.

5. Accounts and users

You sign in with a Microsoft or Google account. We store no passwords.

The subscription gives access for up to 10 users. Each user has a role. A reader reads the newspaper. An editor can also change the watchlist. An administrator can also order the subscription and decide who the users are. The organisation must always have at least one administrator.

You decide who is included, and you are responsible for what your users do in the service. A login must not be shared.

6. Your watchlist

The watchlist can hold up to 100 companies and topics. A topic can be an industry, for example. The watchlist is yours, and only the users in your organisation can see it. No other customer can see which companies you follow.

The information from Enhetsregisteret and the stories in the newspaper are not yours. They are shared by all customers who follow the same company.

Markedsradar is for following businesses and industries, not individuals. You must not add topics or reasons about named private individuals, nor health information or other special categories of personal data.

7. Trial

When you create the organisation, you get 14 days of full access. The trial is free, and you give no payment details.

Each business can have one trial. If you create a new organisation for an organisation number that has already had a trial, it starts without a new trial.

If you have not ordered when the trial ends, the newspaper is locked. After 30 days, the organisation is deleted with the watchlist, the users' access and all other content. We send no invoice unless you have ordered.

If you order within those 30 days, the newspaper opens again as it was.

8. Ordering, price and payment

The subscription costs NOK 990 per month or NOK 9,900 per year. VAT is added. There is one account type, and the price covers up to 10 users and 100 companies and topics.

An administrator orders in the service and chooses to be invoiced monthly or yearly. If you order before the trial ends, you keep the rest of the trial. The subscription starts when the trial ends.

We invoice each period in advance, with 14 days to pay. The invoice is sent as EHF when your business can receive it, and otherwise as a PDF to the email address you give us. Late payment interest follows the Norwegian Late Payment Interest Act (forsinkelsesrenteloven).

If the invoice is still unpaid after a reminder, we may lock the newspaper until it is paid.

We may change the prices with at least 30 days' notice. A new price applies from the next period you pay for.

9. Renewal and cancellation

The subscription renews automatically for a new period of the same length, one month or one year, until it is cancelled.

A cancellation must reach us no later than the day before a new period starts, otherwise the subscription renews. It takes effect at the end of the period you have paid for, and the newspaper stays open until then. If you cancel a subscription ordered during the trial no later than the day before it starts, it does not start, and you receive no invoice. You can switch between monthly and yearly invoicing from the next period, with the same deadline.

For a yearly subscription, we send a reminder by email to the administrators at least 30 days before it renews.

An administrator cancels on the account page in the service, or by writing to hei@fullpeiling.no. A cancellation by email counts from when it reached us. All administrators receive a confirmation by email. An administrator can undo the cancellation on the account page until the period ends, and the subscription then continues as before.

We do not refund a period that has started.

When the subscription ends, the newspaper is locked, and after 30 days the organisation and all content are deleted, as after the trial. If you order again before then, the newspaper opens again as it was. We notify the administrators by email 7 days before we delete.

If you delete the organisation yourselves, it disappears for all users at once, and the subscription counts as cancelled, so it does not renew again. After 30 days the content is removed for good. Until then, you can ask us to restore it.

10. Email from us

During the trial we send three emails from “FullPeiling Markedsradar”: when the newspaper is ready, after one week, and two days before the trial ends. We send the administrators emails about the subscription: the reminder before a yearly subscription renews, a confirmation when the subscription is cancelled, a message when a cancellation is undone, and a notice before everything is deleted when the subscription has ended. We announce important changes to the service in the service itself or by email.

FullPeiling AS follows up the customer relationship. We may contact you about the service, and about our own similar services, at the email address you gave us. You can opt out of such messages easily and free of charge by writing to hei@fullpeiling.no, and every such message tells you how.

11. Availability and changes to the service

We do our best to keep the service available around the clock, but we do not guarantee uninterrupted operation. We announce planned maintenance in advance when possible.

The sources we collect from can change or disappear. We do not guarantee that the newspaper picks up every story about a company, or that a story appears on the day it was published.

We keep developing the service, and may change and remove features. If we remove something significant from the subscription, we give at least 30 days' notice.

12. Liability

The service is provided as is. We are not responsible for the content of the stories at the publishers. Nor are we liable for indirect loss, such as lost profit, or for loss caused by a story being missing, wrong or misunderstood.

Our total liability to you is limited to what you have paid for the service in the last twelve months. The limitations do not apply in cases of gross negligence or intent.

13. Privacy

How we process personal data is described in the privacy notice. What you add to the organisation, such as the list of users and the watchlist, we process on your behalf under the data processing agreement.

14. Breach of the terms

If you breach the terms in a significant way, we may close access after giving notice and a reasonable deadline to put it right. In case of misuse that harms the service or others, we may close access at once.

15. Changes to the terms

We may change the terms. Changes are announced in the service or by email at least 30 days before they apply. If you keep using the service after that, the new terms apply. If you do not accept them, you can cancel with effect from the date of the change.

16. Governing law and disputes

The agreement is governed by Norwegian law. Disputes we cannot resolve together are settled by Bergen District Court (Bergen tingrett).
